TERMS & CONDITIONS

DEFINITIONS

The “Seller” is defined as the legal entity Brighton Cakes Ltd T/A Gingerbread World. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in this invoice.


GENERAL

These Terms and conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Brighton Cakes Ltd you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted on Brighton Cakes Ltd website from time to time.


RESERVATIONS, PAYMENT AND DEPOSIT FOR CUSTOM ORDERS

Any quote is valid for 30 days from date of issue. After this date, we can no longer guarantee your date will be available. We reserve the right to amend the quote if the scope of the work involved changes and issue a new quote to reflect increased or reduced costs.

Once you have confirmed with us you wish to proceed, we require a 50% non-refundable deposit to confirm an order and hold the date.  If the 50% deposit is not paid within seven days of receipt of invoice, the order will be cancelled, and your date will be reopened to other clients. We accept cash, debit or credit card payments and bank transfers. Cash and card payments can be made at our studio. We also accept card payment online through a secure payment system and can send you an electronic link for payment.

A further 30% is due two weeks before the delivery date, at which point all changes must be confirmed (changes to the previously agreed design may incur extra fees). The final balance of 20% specified on the invoice must be paid by the Buyer within seven days of completion of the order. Payment can be made earlier if you wish. Failure to complete payment two weeks before the delivery date may result in your order being cancelled.

For orders booked less than two weeks ahead of the delivery/event date, 100% payment is required before we can begin work. If payment is not received by a stated date, then we will be unable to begin work and the order will be cancelled. This is to protect us in the rare case of last-minute cancellations and no shows. For orders placed with less than two weeks notice a 25% rush fee will be applied to the total value of the order.

By making a payment the Buyer is accepting the Terms and Conditions as detailed on this page.


RUSH ORDERS

Orders placed less than two weeks in advance of the delivery date must be paid in full at the time of booking. A 25% rush fee on the total order value may also be applied. If payment is not received within 24 hours of your order being placed, it will be cancelled. We have limited space for last-minute orders, and they are dependent on our existing schedule and workload, particularly if they involved complex designs or custom materials we need to buy. This takes time and effort and often requires us to pay for priority delivery to ensure your order is perfect! We’re not trying to rip you off, just cover our costs and allow for the extra admin and work last-min orders often involve. Please note your order may be subject to design restrictions given the short lead times involved.


REFUNDS AND CANCELLATIONS

Deposits are non-refundable and non-transferable (as they are date specific) under any circumstances due to any loss of business arising from turning away other bookings on that date.

We cannot refund the cost of any orders cancelled with less than two weeks’ notice. Orders paid in full and cancelled with more than two weeks’ notice will receive a partial refund of 50% of the total amount paid. Any work already undertaken in connection with your order or special materials bought specifically to fulfil your order will be deducted.

If you need to move the date of your celebration, we will do our best to accommodate any changes. However, as we do get booked up, please be aware we may not be able to in which case the above cancellation policy will apply. Please note if you do wish to move the date your order may be subject to additional administrative charges.

If, in the very unlikely event we have to cancel your order for whatever reason, then we will refund the full price to you and recommend an alternative supplier.

We recommend you purchase event insurance cover.


PRODUCT INFORMATION

The images on our website in our online shop are examples of our products. There may be slight variations in decoration as each gingerbread is hand-made by different members of staff.

The images on the bespoke sections of our site are examples intended to illustrate the style and possibilities with regards to bespoke gingerbread houses and cakes. We don’t reproduce exact copies of gingerbread and cakes on our site but will instead create similar items, specific to your needs, style and budget.

Out of respect for other designers in the industry we don’t wholesale copy other cake or gingerbread designers’ work or quote for it. Please feel free to send images to guide us in what you would like for your creation, but we will not reproduce them verbatim. Instead, we will reproduce for you a one-of-kind cake or gingerbread specific for your celebration.


ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

We will always try to accommodate any dietary needs and are able to produce gluten friendly (Our gluten friendly products do not contain any gluten containing ingredients), non-dairy and vegan cakes and gingebread. However, please be aware that while every precaution is made to avoid cross contamination, the products are made in a kitchen where gluten, wheat, dairy, eggs, sulphites and nuts are present.) If you have any questions about special dietary needs, please email us.


Sketches of your cake or gingerbread design will be provided following your consultation. Design can be amended up to two times subsequent to your consultation. If further amendments are required to your design, they may be subject to additional fees.

Due to the time it takes to produce sketches, the service is only provided for gingerbread or cake with a value of more than £350.


PRICE QUOTATIONS

All price quotations, written or verbal, are valid for 30 days from the date of quotation.


ALTERATIONS

If you have any queries or need to make any changes to an order please contact us, in writing, immediately.

We will assess your request, and endeavour to make alteration where possible. This is dependent on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than two weeks before completion may be subject to a surcharge. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.


CAKE STAND HIRE

We no longer hire cake stands. If you require a cake stand for your event you will need to purchase or hire this yourself.


DAMAGES

The Seller accepts no liability for cakes or gingerbread that are damaged after they have been delivered to the agreed location. For cakes delivered to venues, Brighton Cakes Ltd requires a signed delivery note by the person in charge to say that the creatioin has arrived and that it arrived in perfect condition.

We require cakes and gingerbread collected from Brighton Cakes’ premises to be signed for upon collection. Damages which occur after the cake or gingerbread has been signed for are not Brighton Cakes’ responsibility.

Cakes and gingerbread are fragile in nature and require careful handling. Transportation, storage and handling instructions will be provided, and we advise the Buyer to pay careful attention to those instructions.


DELIVERY AND COLLECTION

We cannot be held liable for any damages to the cake or products we have delivered once we have delivered and /or set up the cake or gingerbread at the venue or delivery location and received a signature for the safe receipt of the goods on our delivery note (we will deliver with a delivery note). If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once they have left our premises.

The collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Buyer. The cake or products can be very fragile, so we advise to drive very slowly, practise careful acceleration, allow extra braking distance and purchase non-slip matting.

We will always endeavour to deliver within the given time slot however, delivery timings cannot be guaranteed. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery time.

We are open by appointment only for collections. You will be given a specific time slot for collection of your gingerbread or cake. If you cannot make those timings for whatever reason, please notify us as soon as possible and we will do our best to accommodate. If your collection takes place more than half an hour after your allotted time slot you may be subject to a surcharge of £5 for every half an hour past your collection time.


AFTER DELIVERY

Cakes placed outside may react to temperature, humidity and rain. In hot or humid weather there is a risk of melting or damage to sugar decorations. Rain may also cause damage to sugar decorations. It is the responsibility of the Buyer to check with the venue to ensure the cake or products are placed in a suitable location.

The Seller does not provide linen, cutting knives or cake tables. It is the responsibility of the Buyer to either arrange these items or check with the venue.

A best before date and delivery note is provided with all Goods. Please note, these are advisory only. Event cakes are created for the date of the event and as such their freshness beyond the event cannot be guaranteed. Gingerbread will last longer, around 2-3 months, but we cannot guarantee it beyond that timescale.


NON-EDIBLE INGREDIENTS AND DECORATIONS

Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes, cake toppers, candles, fresh flowers or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed prior to serving or eating.


COMPLAINTS

If you wish to make a complaint to us or let us know any concerns after receiving the Goods, please do so in writing. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.


DATA USE AND PRIVACY

We will keep and use your information solely for the purpose of fulfilling your order and for no longer than is necessary to fulfil any order. We will keep contact information on file for a period of 12 months after your order. We may use your data to provide you with details of any special offers or news which may be of interest during that period, provided we have received your express consent to do so.

We will not share your information with any third parties unless required to do so to successfully complete your order. We will inform you of this if we need to do so. If you would like your personal information removed from our systems please contact us at info@brightoncakes.com. We do not store any credit or debit card information on any of our systems and use a secure payment system to process payments.
